Regulation Alert: California to Consider Adding Cannabis and THC to Proposition 65 Chemical List

New-Prop-65-Warning-Label_large.pngOn October 4, 2019, the California Environmental Protection Agency’s Office of Environmental Health Hazard Assessment (OEHHA) announced that it will consider adding cannabis and THC to the Proposition (Prop) 65 list.

Prop 65 requires the publication of a list of chemicals “known to the state” to cause cancer or reproductive toxicity. The OEHHA of the California EPA is the lead agency for implementing the proposition.

Back in March, OEHHA issued a public request for information on the development of toxicity of cannabis, marijuana smoke, cannabis extracts and THC. On October 4, the Agency announced a meeting to consider including these items on the Prop. 65 list. That meeting will occur on December 11, 2019, 10am – 5pm, in Sacramento, CA.

In the meantime, the Agency is seeking public comment on the issue, with the comment period closing on November 18.
